Why It Matters for Trump

The court’s 6-3 decision could have a big impact on Trump’s second term, even if the birthright order is never enforced. The ruling limits the ability of courts to block his future actions.

Presidents from both parties have criticized nationwide injunctions. Trump has pointed out that he’s faced more of them than any other president. Courts have used them in the past to stop Trump from deporting migrants and banning transgender people from the military.

“This was a big decision,” Trump said, calling it “amazing.”

What Could Still Happen

Private individuals — like the group of pregnant women in this case — might still get temporary blocks through class-action lawsuits. States could also try to stop Trump’s policies for a short time.

Conservative Court, More Trump Wins

This is another big win for Trump at the conservative-majority Supreme Court. Last year, the court ruled that presidents are generally immune from prosecution for things done while in office — helping Trump delay a criminal trial.

Since Trump returned to office in January, the Supreme Court has ruled in his favor multiple times. These include decisions allowing him to deport certain migrants, remove independent agency board members, and ban transgender people from military service.

Friday’s ruling, written by Justice Amy Coney Barrett — whom Trump has criticized — may be his biggest victory yet.

Strong Dissent from Liberal Justices

The court’s three liberal justices strongly disagreed. Justice Sonia Sotomayor said the ruling allows the government to ignore the Constitution. She accused the court of helping the administration by making it harder for judges to block unlawful policies.

She warned that the executive branch could now violate people’s rights without much pushback from the courts.

Justice Ketanji Brown Jackson also wrote a strong dissent, warning that the ruling threatens the rule of law. She said it could lead to a future where the president’s power becomes “uncontainable.”

Focus Shifts to Class-Action Lawsuits

Even though the ruling limits nationwide blocks, it leaves open the option for class-action lawsuits. These allow people to sue on behalf of others who could be affected by a policy.

On Friday, immigrant rights groups and the women suing over the birthright order quickly asked a judge to block the policy again — this time through a class-action case.

The ACLU also filed a new class-action lawsuit to challenge Trump’s order.

States Still Have Options

Justice Barrett noted that parties can still seek nationwide relief in some cases if they can prove they need it. That’s what Democratic-led states argued in this case. They said people could easily move between states to give birth — which could make one state’s policy ineffective.
